REFUND POLICY

1. Reserve Your Spot In The Exclusive Masterclass

ConstructLegalPro operates under a limited refund policy in accordance with applicable Indian laws.

Enrollments in our professional development programs are considered final commitments subject to the terms outlined herein.

2. Non-Refundable Services

The following services are non-refundable once accessed or commenced:

  • Online course materials and digital content after initial 3-day review period
  • Community platform membership and participation
  • 1:1 coaching sessions with Dipen Shah (individual or package bookings)
  • Downloadable resources, templates, and study materials
  • Live webinars and recorded session access

3. Limited Refund Circumstances

Refunds will only be considered under the following exceptional circumstances:[1][2][3]

3.1 Technical Failure

  • Complete inability to access purchased services due to platform technical issues lasting more than 95
    consecutive hours
  • Non-delivery of digital content within 14 days of payment.
  • The course will be unrolled on rolling basis as each chapter is completed by user the next chapter will be
    unlocked to ensure a structured learning methodology. No claim for refund will be entertained on this
    basis.
  • Some of the modules in the course will be launched soon like the FIDIC training and the course
    improvement and new additions of topics will be added at regular intervals. No claim for refund will be
    entertained on this basis.

4. 2-Day Review Period

For digital course content only, students have a limited 3-day review period from the date of enrollment during which they may request a refund if:

  • Course content materially differs from advertised description
  • Technical issues prevent reasonable access to materials
  • Service quality fails to meet basic professional standards
Important: This review period applies only to course content and does not extend to community access, coaching sessions, or other services.

5. Plagiarism and Academic Integrity

5.1 Zero Tolerance Policy

Any student found engaging in the following activities will face immediate dismissal without refund:

  • Severe Plagiarism: Reproduction or distribution of more than 40% of course content, materials, or proprietary methodologies
  • Intellectual Property Theft: Unauthorized copying, sharing, or commercialization of constructlegalpro content
  • Content Piracy: Recording, distributing, or reselling any course materials, sessions, or community content

5.2 Due Process

Before dismissal, the following procedure will be followed:[7][8]

  • Written notice of alleged violation
  • 48-hour opportunity to respond with explanation
  • Investigation by the constructlegalpro team
  • Final determination with written notification

6. Dispute Resolution Mechanism

6.1 Mediation Clause

Any dispute arising from this refund policy or related services shall first be referred to mediation. The mediation shall be conducted through:

  • Mediator Selection: High Court of Gujarat Mediation Centre.
  • Mediation Rules: Indian Law on Mediation.
  • Location: Mediation to be conducted in Ahmedabad, Gujarat, India
  • Language: English
  • Duration: Maximum 60 days from commencement
  • Costs: Each party bears own costs; mediator fees shared equally

6.2 Arbitration Clause

Should mediation fail to resolve the dispute within 60 days, all or any dispute shall be referred to final and binding arbitration under Indian Arbitration and Conciliation Act, 1996 under the following terms:

Arbitration Framework:
  • Governing Act: Arbitration and Conciliation Act, 1996 (as amended)
  • Institutional Rules: Gujarat High Court Arbitration Centre.
  • Number of Arbitrators: Sole Arbitration of a High Court Lawyer or a retired judge as agreed.
Seat and Jurisdiction:
  • Seat of Arbitration: Ahmedabad, Gujarat, India
  • Venue: Proceedings may be conducted in Ahmedabad or virtually as determined by the tribunal
  • Governing Law: Indian law shall govern the arbitration agreement, procedure, and substantive rights
  • Language: English

6.3 International Disputes

For disputes involving international parties or cross-border elements:

  • Seat remains: Ahmedabad, Gujarat, India
  • Venue: Ahmedabad, Gujarat, India.
  • Applicable Rules: MCIA International Arbitration Rules, 2025
  • Governing Law: Indian Contract Act and the Procedural Law of India.
  • Enforcement: Awards enforceable under the New York Convention, 1958

6.4 Exclusive Jurisdiction Clause

The designation of Ahmedabad as the seat of arbitration shall operate as an exclusive jurisdiction clause. The courts of Ahmedabad, Gujarat, India shall have exclusive jurisdiction for:

  • Appointment of arbitrators under Section 11 of the Arbitration Act
  • Interim relief under Section 9
  • Setting aside awards under Section 34
  • Enforcement of awards under Section 36
  • Any other arbitration-related applications
No other court shall have jurisdiction over arbitration-related matters, regardless of where the cause of action may have arisen.

7. Refund Process

7.1 Application Requirements

Refund requests must include:

  • Written application within prescribed timeframes
  • Supporting documentation evidencing grounds for refund
  • Original payment receipts and enrollment confirmations
  • Detailed description of service deficiency or technical issues

7.2 Processing Timeline

Refund requests must include:

  • Acknowledgment: Within 48 hours of receipt
  • Investigation: Maximum 14 working days
  • Decision: Written determination within 21 days
  • Refund Processing: If approved, refunds processed within 7 working days to original payment method

8. Alternative Remedies

In lieu of monetary refunds, constructlegalpro may offer:

  • Service Credits: Credits toward future programs of equivalent value
  • Extended Access: Additional time to access purchased content
  • Substitute Services: Equivalent alternative courses or coaching sessions
  • Supplementary Materials: Additional resources to address service gaps
